PORTSMOUTH, Va. — A Coast Guardsman charged with sexual assault, maltreatment and four other violations of the Uniform Code of Military Justice will face a court-martial, scheduled to convene 9 a.m. Monday at Joint Base Anacostia-Bolling, Washington.
Petty Officer 1st Class Brian Green, is charged with the following Uniform Code of Military Justice violations:
- Article 80 – Attempts
- Article 93 – Cruelty and Maltreatment
- Article 120 – Sexual Assault Generally
- Article 120c – Indecent exposure
- Article 128 – Assault
- Article 134 – General Article
The charges stem from a Coast Guard Investigative Services investigation launched Aug. 29, 2012, in response to two unrestricted reports of sexual assault made by two female Coast Guardsmen. Green is accused of sexual misconduct that includes aggravated sexual assault, indecent exposure, non-consensual sexual touching, making sexual comments as well as attempting to wrongfully access the private spaces of a female member and maltreatment of subordinates, between January 2012 and August 2012, while Green was assigned to a shore-based unit in Washington. The specific unit name is not being released to protect the identity of the victims.
Green has since been reassigned to Coast Guard Sector Baltimore while awaiting trial.
Rear Adm. Steven Ratti, commander of the 5th Coast Guard District, made the decision to convene a court-martial based upon the recommendation from an Article 32 hearing, which reviewed evidence related to charges of maltreatment and sexual assault by Green. An Article 32 hearing does not result in a verdict or a sentence; it only provides a recommendation on how to proceed with the charges.
It was originally reported Article 120c is for aggravated assault. Article 120c charged has been updated to state indecent exposure.
