Coast Guard announces proposed vessel requirements for NOAD, AIS

WASHINGTON — The U.S. Coast Guard announced Thursday that it submitted to the Federal Register a notice of proposed rulemaking entitled “Vessel Requirements for Notices of Arrival and Departure and Automatic Identification System,” a rule designed to increase navigation safety and raise maritime domain awareness.

The changes included in the proposed rule will: expand the applicability of NOAD and AIS requirements to more commercial vessels; modify NOAD reporting requirements; establish a mandatory method for electronic data submission; and establish a separate requirement for certain vessels to submit notices of departure. Under this proposed rulemaking, the applicability of AIS requirements would be extended beyond Vessel Traffic Service areas to all U.S. navigable waters.

These proposed changes will enhance existing NOAD regulations that currently provide the Coast Guard with vessel, passenger, crew and cargo information about ships coming to U.S. ports up to 96 hours before the vessel arrives. It will also improve existing AIS regulations that provide automatically broadcast dynamic, static and voyage-related vessel information such as position, course and speed that can be received by the Coast Guard and others with AIS-equipped stations.

The Coast Guard encourages the public to participate in this rulemaking by submitting comments and related materials to the docket at http://www.regulations.gov, docket number: USCG-2005-21869. All comments received will be posted without change.

    It would seem that the USCG could come up with an unsophisticated “cheep under $5.00” transponder that would just transmit location and ownership. This small battery/solar powered item could be purchased with your small vessel/ personal watercraft registration. At first it could be a volunteer safety device, and then if proven to be effective, could be transformed into a mandatory security device. At that point we could start talking about Maritime Domain Awareness. I know this is viewed as a privacy issue but sometimes compromises have to be made to battle today’s possible maritime threat.

    A cheap fix will work like one. The idea of equipping everything afloat with a transponder is ridiculous. It’s not a privacy issue, it’s about the practical application of technology. I can’t believe that many W.M.D. will arrive by jet ski. You can’t get the boating community to agree to be properly licensed, what kind of coaxing would it take to get the voluntary to become mandatory? Basic safety is hard enough to accomplish, much less a heightened state of “Marine Domain Awareness”.
    As for the U.S.C.G. coming up with a cheap alternative one need only look at the requirements saddling the professional marine community regarding documents and credentials, nothing comes cheap to, or from, the Coast Guard and it seems there’s always time to do it right the second time when it comes to the government. The U.S.C.G. has a very full plate and these changes to the N.O.A.D. and A.I.S. will improve safety for the professional, read large scale, marine community.
